Legal fees for Sale and Purchase Agreements (SPA), Transfers of Property, and Loan Agreements are regulated by the Solicitors’ Remuneration Order 2023.

Stamp Duty for Sale and Purchase Agreements (SPA) and Loan Agreements

Stamp duty for Sale and Purchase Agreements (SPA), Transfers of Property, and Loan Agreements is determined by the Stamp Act 1949 and the Finance Act 2018. The latest stamp duty scale applies to loan agreements dated 1 January 2019 or later, and to sale and purchase agreements and instruments of transfer dated 1 July or later.

Property Valuation Fees

Under the Seventh Schedule of the Valuers, Appraisers, and Estate Agent Rules of 1986, below are the fees charged by licensed property valuers. These fees are typically borne by the property buyer:

  1. 0.25% of the first RM100,000 of the property’s market value
  2. 0.20% of the next RM2 million of the property’s market value
  3. 0.167% of the next RM7 million
  4. 0.125% of the next RM15 million
  5. 0.10% of the next RM50 million
  6. 0.067% of the next RM200 million
  7. 0.05% of the next RM500 million
  8. 0.04% of the amount in excess of RM500 million
